What's an 'AI tool usage clause' anyway?
It's a paragraph that says: 1) you can't use AI tools, or 2) anything you make with AI belongs to them, or 3) you must use their AI tools. It's becoming standard in coding contracts and it's terrible for freelancers.
Is this even enforceable?
Sometimes yes, sometimes no. But fighting it in court costs $50k. Better to not sign it in the first place. We point out which ones are legal landmines.
Can they really force me to use their AI tools?
If you sign that clause, yes. I've seen contracts that require using the client's 'approved' AI coding assistant and deducting the cost from your rate. It's absurd but it's in there.
Does this apply to Upwork/Fiverr contracts?
Absolutely. Most platform TOS have AI clauses buried in section 14. We check those too. If you're coding for money, you need to read this.
What if I already signed it?
We'll tell you what you can still negotiate. Some clauses have 'notice periods' or 'audit rights' you can push back on. Better late than never.
