Reviewing Drone Operator Service Agreement for Privacy Trespass Clauses

Legal Definition

A privacy trespass clause in a drone service agreement is a contractual provision that prohibits the operator from using the drone's sensors (cameras, microphones, thermal imagers, etc.) to intentionally or negligently observe, record, or collect data from areas where a person has a reasonable expectation of privacy, such as inside a private residence, fenced backyard, or other secluded property, without explicit prior consent.

In Plain English

It's a rule in a drone contract that stops the pilot from spying on you in your private spaces with the drone's camera or other gadgets. It says the drone can't be flown over your home or yard to watch you without your okay.

Example in a Contract
Operator shall not, and shall ensure its agents and subcontractors do not, intentionally or negligently operate the Aircraft or utilize its Payload to conduct aerial surveillance, capture imagery, or collect data from any location where a Data Subject has a reasonable expectation of privacy, including but not limited to the interior of a private residence, a fenced or otherwise enclosed backyard, or a private patio. Operator must obtain verifiable written consent from the property owner or lawful occupant prior to any overflight of such locations. All flights must comply with applicable state common law on intrusion upon seclusion and federal/state privacy statutes.
