Pest Control Cost Allocation in Grain Storage Facility Leases

Legal Definition

A contractual provision within an agricultural or commercial lease for a grain storage facility that specifies which party (landlord or tenant) is responsible for the costs of pest control services, treatments, and preventative measures. It delineates financial responsibility for inspections, fumigation, structural pest management, and related compliance with food safety and agricultural regulations.

In Plain English

A specific part of a grain storage lease that says who has to pay for keeping insects and rodents out of the stored grain. It decides if the building owner or the farmer renting the space foots the bill for sprays, traps, and inspections.

Example in a Contract
Section 14. Pest Control and Sanitation. (a) Landlord shall be responsible for the cost of all structural pest control and rodent abatement services for the building's foundation, walls, and roof, performed on a quarterly basis by a licensed professional. (b) Tenant shall be responsible for all costs associated with the fumigation of stored grain, internal bin treatments, and pest control within the grain mass itself. Tenant shall also bear the cost of any pest control required due to its specific grain types or storage practices. (c) Both parties shall cooperate and provide reasonable access for scheduled pest control activities. Costs for pest control necessitated by the other party's negligence shall be borne by the negligent party.
