Hidden Maintenance Fees in Property Management Contracts
Legal Definition
Hidden maintenance fees are charges for property upkeep and repairs that are not transparently disclosed in a property management agreement or lease. They are often embedded in vague clauses, such as 'tenant responsible for all maintenance costs,' allowing landlords or property managers to bill tenants or owners for expenses that should be their responsibility, without clear itemization or prior consent.
In Plain English
These are sneaky fees for fixing things in your rental that the landlord hides in the contract. You only see them when a big bill arrives, like for a new roof or boiler.
Example in a Contract
Section 14. Maintenance and Repairs: Tenant shall be responsible for all costs associated with maintaining the Premises in good condition, including HVAC, plumbing, electrical, and structural components, as determined by Landlord in its sole discretion. Landlord may invoice Tenant monthly for such expenses, payable within fifteen (15) days of receipt.
