Legal Term
Constructive Eviction
Legal Definition
A legal doctrine where a landlord's failure to maintain the premises or actions that substantially interfere with the tenant's use and enjoyment constitutes a breach, allowing the tenant to terminate the lease and vacate without liability for future rent, provided certain conditions like notice and opportunity to cure are met.
In Plain English
When your landlord doesn't fix serious problems, making your home or business unlivable or unusable, you can move out and stop paying rent without penalty, if you follow the rules.
Example in a Contract
If Landlord fails to maintain the Premises in compliance with all applicable health and safety codes, and such failure is not cured within 30 days after written notice from Tenant, Tenant may terminate this Lease by providing additional written notice and surrendering possession of the Premises, with no further obligations under this Lease.
