DIY Review of Homeowner Association Bylaws Amendment Voting Rights

Legal Definition

The process by which homeowners independently assess the provisions in their homeowners association's bylaws that govern the rights, procedures, and thresholds for amending those bylaws through voting, including quorum requirements, voting majorities, eligibility to vote or propose amendments, and notice provisions, as typically derived from state statutes and association governing documents.

In Plain English

When homeowners check on their own how they can vote to change the rules of their HOA, like what percentage of neighbors must agree and who gets to vote.

Example in a Contract
Section 8.2 Amendment of Bylaws: These Bylaws may be amended only by the affirmative vote of two-thirds (2/3) of the votes of the Members present in person or by proxy at a duly called meeting of the Members, provided that a quorum of not less than ten percent (10%) of the total votes of the membership is established. Notice of any meeting at which an amendment is to be considered shall state that a purpose of the meeting is to consider such amendment.
